* the style or purpose of the finished video.We use this information to understand your requirements and create your requested video.Your responsibility for photographs and videosWhen submitting photographs or videos, you will be asked to confirm that you have the necessary rights, permissions or authority to provide the material to VIDEGO for the purpose of creating your video, including where it contains images or recordings of other people.You remain responsible for ensuring that you have the appropriate authority to provide the material.This declaration does not remove any legal obligations that VIDEGO may have under applicable data-protection law.4. ChildrenCustomer photographs and videos may contain images or recordings of children.VIDEGO does not ordinarily collect information directly from children as part of its standard service. Where children appear in customer-supplied photographs or videos, their information is generally processed as part of fulfilling the customer's request.Where promotional use of a finished video is requested, we require the customer to confirm that they have the necessary authority to give the relevant permission, including where identifiable children appear in the video.We take particular care when processing or publicly displaying information involving children.5. Photographs and video clips you provide to VIDEGO for the purpose of creating your video are normally deleted within 30 days of the finished video being sent to you.
We may retain this material for longer where reasonably necessary, for example to deal with an unresolved issue, correction, dispute, legal claim or other lawful requirement.Finished videosWe may retain your finished video for up to one year following completion, where reasonably justified. Promotional Use of Your Finished VideoVIDEGO may ask whether you are willing to allow your finished video to be used for promotional purposes on our business social-media accounts, including Instagram and TikTok.This is separate from the processing required to create and deliver your video.We will only use your finished video for promotional purposes where the relevant permission has been provided.Where promotional permission is requested, our customer form will ask you to confirm that you have the necessary authority to provide that permission for identifiable individuals appearing in the video, including children where applicable.You may withdraw your promotional permission by contacting us.Where reasonably practicable, VIDEGO will stop future promotional use and remove relevant promotional material from accounts or platforms under our control following withdrawal.Withdrawal of promotional permission does not affect processing that took place lawfully before the withdrawal.8. Third-Party Service ProvidersWe use selected third-party services to operate VIDEGO and provide our services.These may include providers of:* online forms and customer submissions;
* secure file storage and transfer;
* payment processing;
* email and communications;
* website hosting;
* video-editing software;
* AI-assisted technology; and
* social-media platforms where promotional use has been authorised.Depending on the particular processing involved, a third-party organisation may act as a processor on our behalf or may process information as an independent controller for its own purposes.We take appropriate steps to ensure that third-party processing is handled in accordance with applicable data-protection requirements.9. AI-Assisted and Online TechnologyVIDEGO may use AI-assisted technology and online services as part of producing or supporting the production of customer videos.Depending on the work required, this may involve the use of AI-assisted features provided by third-party technology and software providers.The particular services used may vary depending on the requirements of the video.Your photographs, videos or other information will not necessarily be processed by every AI service available to VIDEGO.Some video-editing software also provides cloud, online or AI-enabled functionality. Where such functionality is used, customer information may be processed through the relevant online service.Where customer material is processed using AI-assisted or online technology, VIDEGO will consider the relevant privacy, security, retention and international-transfer arrangements and apply appropriate safeguards where required.10. International ProcessingSome of the third-party service providers used by VIDEGO may process or make personal information accessible from countries outside the United Kingdom.Where a transfer is subject to the UK GDPR's international-transfer requirements, VIDEGO will ensure that an appropriate lawful transfer mechanism and safeguards are in place.These may include an applicable adequacy regulation or appropriate contractual safeguards, such as the UK International Data Transfer Agreement (IDTA) or UK Addendum, where applicable.If you require further information about the safeguards applicable to a particular transfer, you can contact us using the details provided below.11. How Long We Keep Your InformationWe do not keep personal information indefinitely.We apply different retention periods depending on the type of information and why we need to retain it.Customer photographs and video clipsPhotographs and video clips that you provide to VIDEGO for the production of your video are generally deleted within 30 days of the completed video being sent to you.This period allows us to deal with any reasonable immediate customer queries, corrections, technical issues or problems relating to the completed video before the source material is deleted.Finished videosWe generally retain the finished video for up to one year following completion of the work.This provides a reasonable period in which we may be able to assist with issues such as lost or corrupted customer files, reasonable customer queries, remedial work or disputes.You should retain your own copy of the finished video once it has been delivered to you.Customer declarations and permissionsCustomer declarations concerning the submission of photographs and videos, together with promotional permissions, may be retained for longer than the photographs and video clips themselves where reasonably necessary to demonstrate the circumstances in which instructions, declarations or permissions were provided, deal with disputes or establish, exercise or defend legal claims.Financial records
Payment, accounting and tax records may be retained for periods required by applicable legal, tax and accounting requirements.DeletionWhen information is no longer required for the relevant purpose, we will take reasonable steps to securely delete it unless we have a lawful reason to retain it for longer.13. About These TermsThese Terms & Conditions apply to services provided by VIDEGO.By placing an order with VIDEGO, you agree to these Terms & Conditions.These Terms apply alongside VIDEGO's Privacy Policy and any specific information provided to you during the ordering process.Nothing in these Terms is intended to exclude or restrict any statutory rights that cannot lawfully be excluded or restricted.2. The VIDEGO ServiceVIDEGO creates personalised videos using photographs, video clips and other information supplied by customers.Available packages, prices and approximate video durations are displayed on the VIDEGO website or during the ordering process.The finished video is a creative service. The precise visual arrangement, editing style, transitions, timing and presentation may vary according to the material supplied and the creative requirements of the project.VIDEGO will provide the service with reasonable care and skill.3. Customer Information and MaterialsYou are responsible for ensuring that the information and material you provide to VIDEGO is accurate, suitable and appropriate for your requested production.This may include:photographs;
video clips;
audio or music supplied by you;
names;
descriptions;
memories or contextual information;
and other information necessary to create your requested video.
Please do not provide information that is unnecessary for the production.4. Customer Rights, Permissions and AuthorityBefore submitting photographs or videos, you must confirm that you have the necessary rights, permissions or authority to provide them to VIDEGO for the purpose of creating your requested video.This includes material containing identifiable individuals.You are responsible for ensuring that you are entitled to provide the material and instructions to VIDEGO.VIDEGO does not routinely verify the ownership, copyright or personal circumstances of every individual appearing in customer-supplied material.Your declaration does not remove any legal obligations that may apply to VIDEGO itself.5. Children and Other IndividualsCustomer-supplied photographs and videos may contain children or other identifiable individuals.You must ensure that you have appropriate authority to provide the material and give VIDEGO the relevant instructions.Where you request promotional use of a finished video containing identifiable individuals, you must separately confirm that you have the necessary authority to provide that permission, including appropriate parental responsibility or other authority where children are involved.VIDEGO may decline or restrict promotional use where it reasonably considers that appropriate authority or permission has not been established.6. Promotional UseSubmitting photographs and videos for the purpose of producing your video does not automatically give VIDEGO permission to publish them for promotional purposes.Where you choose to allow promotional use, the relevant permission will be obtained separately through the ordering process.Promotional use may include publication of the finished video through VIDEGO-controlled social-media accounts, including Instagram and TikTok.You may withdraw promotional permission by contacting: [email protected]VIDEGO will assess the request and, where appropriate, cease future promotional use and remove relevant material from VIDEGO-controlled accounts where reasonably practicable.VIDEGO may retain evidence of permission and its withdrawal where reasonably necessary for accountability or legal purposes.7. Music, Stock Material and Other Third-Party ContentVIDEGO will seek to use appropriately licensed material where it supplies music, stock footage, graphics or other third-party content as part of your production.Where you supply third-party material, you remain responsible for ensuring that you have the necessary rights to provide and use that material.Where commercially licensed editing or creative materials are used by VIDEGO, they will be used in accordance with the applicable licence restrictions.8. Artificial Intelligence and Online ServicesVIDEGO may use appropriate artificial-intelligence or online-assisted services in connection with its production process where reasonably necessary or beneficial.Your material will not necessarily be processed through every AI or online service available to VIDEGO.Where AI or online processing involves your personal information, VIDEGO will consider the relevant privacy, security, supplier, retention and international-transfer implications.VIDEGO may use AI-assisted functionality provided by its editing or technology suppliers where appropriate.The use of AI does not change VIDEGO's responsibility to process your information lawfully and appropriately.9. OrderingYou must provide the information requested during the ordering process.Before submitting an order, you will have an opportunity to review the information provided and correct errors where the ordering system allows.You are responsible for ensuring that the information provided is accurate.Your final order is subject to these Terms & Conditions.10. Prices and PaymentPrices are displayed during the ordering process.You must pay the applicable price before VIDEGO begins production unless otherwise agreed.Payments will be processed through VIDEGO's designated payment provider.VIDEGO does not intentionally collect or retain complete payment-card details for its own purposes where those details are processed by the payment provider.Payment and transaction records may be retained for legitimate business, accounting, tax, refund, chargeback, dispute-resolution, fraud-prevention and legal purposes.11. When the Contract Is FormedYou place an order by completing the ordering process and submitting your order with the required payment.You will be shown the applicable price and key order information before submitting the order.The payment/order button will clearly indicate that submitting the order creates an obligation to pay.A contract is formed when VIDEGO accepts your order and payment has been successfully processed.VIDEGO will provide confirmation of the contract by email.You should retain the confirmation email and these Terms & Conditions for future reference.12. ProductionVIDEGO will normally begin production after:* payment has been successfully received;
* the required customer information has been provided;
* and the required photographs and video clips have been uploaded.VIDEGO will use reasonable efforts to complete the video within the stated or agreed timeframe.The production timeframe may be affected by:* incomplete customer information;
* delayed uploads;
* unsuitable or corrupted files;
* unusually large quantities of material;
* customer-requested changes;
* technical problems;
* third-party service issues; or
circumstances outside VIDEGO's reasonable control.13. Review, Corrections and RevisionsFollowing delivery of your finished video, you should review it promptly.You should notify VIDEGO of any required corrections or changes within 48 hours of receiving the finished video.VIDEGO will be happy to correct genuine errors or omissions attributable to VIDEGO.Examples may include:* an agreed name being displayed incorrectly;
* an agreed photograph being omitted accidentally;
* an obvious editing error; or
another mistake resulting from VIDEGO's production process.Customer-requested creative changes are different from correcting an error.Examples may include:* requesting a different sequence;
* replacing several photographs;
* requesting a different style;
* changing the music;
* changing the structure;
* requesting substantial re-editing; * or requesting numerous amendments.VIDEGO may make reasonable minor adjustments where appropriate.However, substantial, extensive or numerous customer-requested changes may incur an additional charge.VIDEGO will normally inform you of any additional charge before carrying out chargeable additional work.The 48-hour review period does not remove or restrict any statutory rights you may have.14. Delivery of the Finished VideoThe finished video will normally be provided electronically.You are responsible for ensuring that the email address provided to VIDEGO is accurate and capable of receiving relevant communications.
You should download and retain your finished video.Once delivered, VIDEGO cannot guarantee permanent access to the finished video through VIDEGO's systems.15. Customer Media RetentionVIDEGO does not intend to retain customer photographs and video clips indefinitely.As part of its normal operating process, customer photographs and video clips used in production will normally be deleted within 30 days of the finished video being sent to you, subject to any lawful reason requiring temporary or longer retention.Such reasons may include:* an unresolved customer issue;
* a correction or remedial request;
* a dispute;
* legal requirements; or
the establishment, exercise or defence of legal claims.16. Finished Video RetentionVIDEGO may retain a copy of your finished video for up to one year following completion of the work, where reasonably justified.This may assist with:* customer queries;
* reasonable corrections;
* loss of your downloaded copy;
* technical problems;
* disputes; or
* legal claims.You are responsible for retaining your own copy of the finished video.The retention period does not mean that VIDEGO guarantees the finished video will remain available for the entire period.17. VIDEGO's 24-Hour Cancellation PolicyYou may cancel an order within 24 hours of placing the order by contacting: [email protected]Where:cancellation is received within 24 hours; and
VIDEGO has not begun substantive production work,
VIDEGO will provide a full refund of the amount paid.For this purpose, substantive production work may include:* preparing customer material specifically for the production;
* creating the customer's editing project;
* commencing substantive editing;
* undertaking production work; or
using third-party production or AI services specifically for the customer's project.Routine administrative processing of an order does not, by itself, constitute substantive production work.This 24-hour cancellation policy is an additional VIDEGO policy and does not limit or replace statutory consumer cancellation rights.18. Statutory Consumer Cancellation RightsNothing in these Terms limits or excludes any statutory consumer rights.Where the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply, a consumer entering into a distance contract for services will generally have a 14-day cancellation period beginning when the contract is entered into.VIDEGO will provide the required information concerning the right to cancel and how that right may be exercised.You may cancel by clearly communicating your decision to VIDEGO, including by contacting:
[email protected]A standard cancellation form will also be made available where required.19. Commencement of the Service and CancellationVIDEGO will normally begin production after successful payment and receipt of the information and customer material required to provide the service.You do not need to wait until the end of any statutory cancellation period before VIDEGO begins work.During the ordering process, you will be asked to expressly request that VIDEGO begins providing the service immediately following successful payment and acceptance of the order.Where you subsequently exercise a statutory cancellation right after VIDEGO has begun providing the service, VIDEGO may be entitled to receive a proportionate amount for the service provided up to the point of cancellation, where permitted by applicable law.Where the service has been fully performed following your express request for VIDEGO to begin immediately, and the applicable statutory requirements concerning acknowledgement of the loss of the cancellation right have been satisfied, your statutory cancellation right may end.Nothing in this section limits or excludes any statutory consumer rights.20. RefundsWhere a refund is due under these Terms or applicable law, VIDEGO will normally process the refund using the original payment method where reasonably possible.Where you exercise a statutory cancellation right, any refund will be handled in accordance with applicable legal requirements.Nothing in these Terms prevents you from exercising a statutory right to a refund or other remedy.21. Customer-Requested Changes Before ProductionYou should provide complete and accurate instructions before production begins.Where you request material changes after production has begun, VIDEGO will consider whether the changes can reasonably be accommodated.Where substantial additional work is required, VIDEGO may inform you of any additional charge before undertaking that work.VIDEGO will not impose an additional charge without informing you where the charge arises from requested additional work.22. Customer ResponsibilitiesYou are responsible for:* providing accurate information;
* providing suitable photographs and video clips;
* having appropriate rights and authority to provide the material;
* ensuring that supplied material does not knowingly infringe another person's rights;
* reviewing the finished video;
* communicating required corrections within the applicable review period; and
retaining your own copy of the finished video.22A Customer Backup ResponsibilityYou should keep your own copies of all original photographs and video clips before uploading them to VIDEGO. VIDEGO is not a backup or storage service, and while reasonable care is taken with your material, VIDEGO cannot be responsible for the only surviving copy of any file.23. Privacy and Data ProtectionVIDEGO processes personal information in accordance with its Privacy Policy.The Privacy Policy explains how VIDEGO collects, uses, stores, shares and deletes personal information.Customer photographs, videos and related information may be processed by VIDEGO and relevant service providers where necessary to provide the requested service.VIDEGO may use third-party providers involved in:* customer information collection;
* payment processing;
* file storage;
* email;
* website hosting;
* video editing;
* AI-assisted functionality; and
promotional publication where the appropriate permission has been provided.Further information is contained in VIDEGO's Privacy Policy.24. ComplaintsIf you have a concern about the service, please contact:
[email protected]VIDEGO will seek to resolve genuine complaints reasonably and proportionately.Please provide sufficient information to allow VIDEGO to understand and investigate the issue.Nothing in this complaints procedure removes any statutory rights available to you.25. Reasonable Care and SkillVIDEGO will provide its services with reasonable care and skill.Nothing in these Terms excludes or restricts liability or statutory rights where doing so would be unlawful.VIDEGO is not responsible for problems caused by:* customer-supplied material that is corrupted or unusable;
* inaccurate customer instructions;
* customer equipment or software;
* third-party service outages;
* circumstances outside VIDEGO's reasonable control; or
other circumstances that could not reasonably have been prevented.Where VIDEGO is responsible for an error, it will seek to provide an appropriate remedy, which may include correcting the work.
25A Limitation of LiabilityVIDEGO’s total liability to you in connection with your order, however arising, will not exceed the total amount you paid for that order. This limit does not apply to death or personal injury caused by negligence, fraud, or anything else that cannot lawfully be limited or excluded.25B. Exclusion of Indirect LossVIDEGO will not be liable for indirect or consequential losses, including loss of enjoyment, distress, or costs relating to an event or occasion, arising from any issue with your order. This does not affect any statutory rights you may have.25C Loss or Damage to Media Caused by VIDEGOWhile VIDEGO takes reasonable care to protect the photographs and video clips you provide, VIDEGO cannot guarantee against loss, corruption, or accidental deletion of your material, including material held with third-party services such as Dropbox. Where loss or damage to your original material occurs and is attributable to VIDEGO, VIDEGO’s liability will be limited in accordance with clause 25A.You are strongly advised to retain your own copies of all original photographs and video clips before providing them to VIDEGO (see clause 22A).26. Events Outside Reasonable ControlVIDEGO will not be responsible for delay caused by circumstances outside its reasonable control.These may include significant:• internet failures;
• third-party platform outages;
• cloud-storage failures;
• payment-provider failures;
• software failures;
• equipment failures;
• power failures;
• cyber incidents; or
• other circumstances beyond VIDEGO's reasonable control.VIDEGO will nevertheless take reasonable steps to minimise disruption.27. Intellectual PropertyUnless otherwise agreed, the customer's rights in their own photographs, video clips and other material remain with the customer or the relevant rights holder.VIDEGO retains rights in its own original editing techniques, templates, processes and other underlying creative materials, subject to any third-party rights.The customer receives the right to use their completed video for their own personal or agreed purposes once it has been supplied.The customer must not represent VIDEGO's underlying templates, production materials or third-party licensed materials as their own independent assets where doing so would breach applicable rights or licences.28. Promotional Material and Third-Party PlatformsWhere promotional permission has been provided, VIDEGO may publish the relevant finished video through its business social-media accounts.Social-media platforms operate independently and may process published material according to their own terms and privacy policies.VIDEGO cannot guarantee how long a third-party platform will retain or display promotional material once published.VIDEGO will nevertheless take reasonable steps within its control to honour a valid withdrawal of promotional permission.29. Changes to These TermsVIDEGO may update these Terms from time to time.The version applicable to an order will normally be the version presented to the customer at the time the order is placed.Changes will not retrospectively remove rights already acquired by a customer.Where a material change affects future orders, the updated Terms will be made available before the customer places the relevant order.30. Governing LawThese Terms are governed by the law of England and Wales.Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory consumer rights concerning jurisdiction that may apply.31.
